1. About these terms
These terms and conditions apply to the sale of artwork, workshops and one-to-one lessons by Eva Merendes Art (“I”, “me”, “my”).
By purchasing a product or booking a workshop or lesson, you agree to these terms.
2. Orders and bookings
Artwork
Orders for artwork are confirmed once full payment has been received.
Workshops and lessons
Bookings are confirmed once payment has been received. I reserve the right to refuse or cancel a booking at my discretion.
3. Service locations
Workshops and one-to-one lessons may take place at:
my studio
third-party venues (such as cafes, art spaces or event locations)
a client’s home or chosen location
When services take place at a third-party venue or client location:
you agree to comply with any rules or requirements set by that venue or host
I am not responsible for the acts, omissions or facilities of third-party venues
where sessions take place at a private location, the client is responsible for ensuring a safe and suitable environment
4. Prices and payment
All prices are listed in GBP (£) and are subject to change. Payment must be made in full at the time of booking or purchase unless otherwise agreed.
5. Cancellations and refunds
Workshops
If you cancel:
More than 7 days before the workshop → full refund
Less than 7 days before → no refund (you may request to transfer your place, subject to availability)
Workshops are subject to a minimum number of participants.
If this minimum is not met, I reserve the right to cancel or reschedule the workshop.In this case, you will be offered:
a full refund, or
the option to transfer to another date
I may also cancel or reschedule a workshop due to unforeseen circumstances (e.g. illness, venue issues). The same options (refund or transfer) will apply.
One-to-one lessons
At least 48 hours’ notice is required to cancel or reschedule a lesson
Cancellations made with less notice may be charged in full
Artwork
If you are purchasing as a consumer online, you may have a right to cancel your order within 14 days under UK consumer law.
You must notify me within 14 days of receiving the item
Items must be returned in their original condition
Return shipping costs are your responsibility unless the item is faulty
Refunds will be processed once the item is received.
6. Delivery
Delivery times are estimates and may vary. I am not responsible for delays outside my control. Risk in the artwork passes to you upon delivery.
7. Workshops and participation
Workshops may take place at a variety of venues, and details will be provided at the time of booking.
By attending a workshop or lesson, you agree to:
behave respectfully towards others
follow any health and safety instructions
take responsibility for your own belongings
I reserve the right to refuse participation or remove anyone whose behaviour is disruptive or unsafe, without refund.
8. Children
For workshops or lessons involving children:
bookings must be made by a parent or legal guardian
children must be supervised where required
relevant information (e.g. allergies or medical conditions) must be disclosed where necessary
9. Health and safety
Participation in workshops and lessons is at your own risk. While I take reasonable care to provide a safe environment, I am not responsible for:
injuries resulting from failure to follow instructions
allergic reactions where relevant information has not been disclosed
Where sessions take place at a client’s home, the client is responsible for providing a safe and appropriate environment.
10. Photography and video
I may occasionally take photographs or short videos during workshops or lessons for use on my website, social media or promotional materials.
I will always seek permission before taking or using any identifiable images of you or your child
If you prefer not to be photographed or recorded, please let me know at the start of the session
You may withdraw your consent at any time by contacting me
I will always aim to use images respectfully and appropriately.
11. Intellectual property
All artwork, designs and teaching materials remain my intellectual property.
You may not:
reproduce
distribute
sell
or use my work commercially
without my written permission.
12. Liability
Nothing in these terms excludes or limits liability where it would be unlawful to do so.
To the extent permitted by law, I am not liable for:
indirect or consequential losses
loss of profits or opportunities
My total liability in relation to any claim shall not exceed the amount paid by you.
13. Force majeure
I am not responsible for delays or cancellations caused by events outside my reasonable control, including illness, travel disruption, venue issues or other unforeseen circumstances.
14. Privacy
Your personal data will be handled in accordance with my Privacy Policy.
15. Changes to these terms
I may update these terms from time to time. The latest version will always be available on my website.
16. Governing law
These terms are governed by the laws of England and Wales, and any disputes will be subject to the jurisdiction of the English courts.
